Truckline Damaged / Lost Freight Claim Policy 2010
As a distributor, it is our goal to ship your customer’s truckline orders quickly and accurately, and to ensure that they arrive in tact without damage or missing packages. However, it is inevitable that occasionally a trucking company will damage products on a skid, or break the shrink wrap on a pallet and lose a box in-transit. All Around Pool Builders must be notified of the viable damage/lost freight within 1 week of delivery.
Our Philosophy and General Statement on Responsibility:
It is VERY IMPORTANT that you are well informed of the liability of signing for a truckline order as stated here:
- If the homeowner accepts and signs the delivery receipt for a damaged shipment, without noting the damage or missing parts, there is no recourse that can be taken. The trucking company no longer takes responsibility for damages if the customer signs “free and clear.”
- If the homeowner signs for the exact piece count that is stated on the delivery receipt when they actually received fewer pieces, there is no recourse that can be taken. Again, the carrier views this as the homeowner signing for the delivery “free and clear”; therefore, the trucking company does not take responsibility for any missing pieces.
- If concealed damages are discovered after the homeowner signs “free and clear” for the delivery; there is only a small probability of reimbursement, and the maximum reimbursement amount is 15% of the products total value

All Around Pool Builders can only
take responsibility for damaged or lost freight claims when the homeowner has properly noted the damage or missing packages on the delivery receipt. In these cases, All Around Pool Builders will do their best to expedite the resolution of these claims, issuing a credit to the dealer for the value of the product and any freight cost associated with the claim.
In order to minimize lost or damaged freight, All Around Pool Builders takes several steps in packaging our truckline orders. The majority of orders contain the following preventive measures; therefore, it’s important that the homeowner checks for these things before signing the delivery receipt:
- Truckline shipments are stacked carefully and shrink wrapped thoroughly to avoid damages and missing merchandise.
- After shrink-wrapping, all skids are sealed with white tape printed with the words, “Do not break stretch wrap.” This is intended to stop carriers from breaking apart skids. Broken or missing tape should alert the homeowner to a potential problem with the delivery.
- Each skid includes a bright orange label stating, “Failure to inspect this shipment will render you liable for all damages.” This is a gentle reminder to the homeowner to inspect the merchandise before signing the delivery receipt.
We recommend that you require your customers to read and sign off that they understand the importance of properly inspecting and signing for their delivery. In the unfortunate situation where a shipment is damaged or a package is missing, please follow these steps:
What to do when damaged or missing freight is discovered?
- In the event that a shipment is delivered to the homeowner damaged or incomplete, and that damage or missing box is visible (e.g. crushed carton, hole(s) in carton), the customer must sign for the shipment as damaged or incomplete
. A simple notation on the delivery receipt of the type/number of boxes damaged, or number of boxes signed for (in the case that not all pieces are accounted for) is sufficient. All Around Pool Builders must be notified of the damage/lost freight within 1 week of delivery. The damaged item should be held by the homeowner in its original packaging for 14 days after the claim is made with All Around Pool Builders for inspection or pick up by the carrier. The customer should advise All Around Pool Builders if a replacement order is needed.
- In the event that a shipment is delivered to the homeowner damaged or incomplete, and that damage or missing box is visible (e.g. crushed carton, hole(s) in carton), but the customer signs for the merchandise without exception
, the customer has confirmed acceptance of the shipment. No freight claim can be filed since the delivery was signed “free and clear” by the homeowner.
- In the event that merchandise is delivered to the customer damaged and the customer signed for the shipment “free and clear” but later claims there was concealed damage
, All Around Pool Builders will file a claim with the carrier on behalf of the Dealer. Notification of concealed damage must be reported to All Around Pool Builders within 2 – 4 days of delivery. Concealed damage claims have a very small probability for reimbursement from the carrier, with a maximum reimbursement of 15%. Digital photos are required.
All Around Pool Builders cannot deal directly
with the homeowner on freight issues. Homeowners who contact us regarding damage or lost items will be instructed to contact the Dealer with any questions or concerns.
- Upon notice of the damaged or missing packages, we will immediately begin the claims process with the carrier.
Resolution of your damaged/lost freight claims:
- If the claim is made within 1 week of delivery and
- For all other claims where the homeowner is claiming concealed damages, we can only issue a credit toward the original order based on the resolution of the claim with the carrier. This may take up to 120 days. we can verify that the homeowner did sign for the damaged or lost merchandise properly, then we will issue a credit toward the original order immediately.
- Upon the customers’s request, we will place a new order for a replacement shipment to the homeowner.
